      ginkiha gave the track EOS as a contribution to the open project BMS of Fighters, which distributes the music freely and allows others to use the music freely for other creative projects as long as credit is given. As far as I know, ginkiha doesn't have the authority to renege permission for EOS to be used given the terms of its contribution to the project of BoF.

        you don't know if ginkiha agreed to anything that could undo that when he got eos into sdvx but tbh it seems likely to me that "infinite edit" was added to allow previous cuts to remain open source

          No it can't because we don't have blanket or partial permission from Metallica, or from any label or project under which Metallica has released music, so it's not comparable.

            Can you show where it's signed to this label? From searching I only see it as part of the True Blue album and not under Bemani in any way.

            Additionally, are there any bilingual Japanese/English speakers who can make clear and unambiguous sense of P*Light's permission terms listed on his website, Especially in regards to what "circles" means?

            Jimerax only ambiguously says "basically, almost everything", but there is something specific mentioned in the terms that should be clearly determined for FFR's sake.

              on second glance the album was released by konami itself

                The thing is, I don't even know if we need permission from whoever it was released under, and if we do, in what cases we would need it. "基本的に連絡は不要ですが、商用利用の場合は必ずご連絡ください。他サークル様へ提供した楽曲は、主催サークル様の指示に従って下さい。" comes out as "Basically, contact is not required, Please contact me in case of commercial use. And the music is provided to the other circle-like, follow the instructions in the organized circle like." in Google translate.

                  Yeah, this is about right. I've seen サークル referring to school clubs and doujin groups. "An association of like-minded people." A group of people releasing music together would be a サークル, but an actual record label might fall under 企業 (business).

                  他サークル様へ提供した楽曲は、主催サークル様の指示に従って下さい。
                  For music offered to other circles, you most follow the rules of the circle's organizer.
                  企業に提供した楽曲に関しましては二次利用を一切禁止します。
                  Music offered to a business is entirely prohibited from secondary use.

                  JX did say "anything but songs copyrighted by a company." I guess getting a track into a Bemani game counts as offering it to a business?

                  True Blue is on Konami's website, and Konami is listed as the distributor on its store page. The amazon.co.jp page says its label is "SMD itaku (music)", which ... I don't know? It's the same for the beatmania IIDX 21 SPADA thing mentioned on the same Konami page. So, a track has to be offered to Konami for them to be able to release it on a CD? I think? And if we can't find what the exact agreement was, would it be better to play it safe?

                  Yeah, that e-mail was sent by me. I didn't notice at the time that, on P*Light's soundcloud page, you can see that the Hommarju remix is a repost of the track from Hommarju's page. (You can see the icon of the two arrows in a rectangle).

                  But also, I only just checked the pichnopop discography, and TRIGGER★HAPPY (Hommarju Remix) was released on one of their CDs. Therefore, it falls under the same rules, so you don't need to contact the artist. Sorry for the confusion. I'll put it back on the list. It's more in the clear than the others, because it's not featured in anything from Konami.

                      To be honest, none of the SDVX FLOOR songs seem like they should be available.

                      When BlackY released MAXXXBURNING!!!, they had to license Max Burning!! back from KONAMI.
                      When C-Show released HOLIX, they had to license PANIC HOLIC back from KONAMI.
                      And so on for every album with a SDVX long version on it.

                      When artists submit songs to SDVX FLOOR, they forfeit their rights to them - so, say, For UltraPlayers probably isn't covered by Cosmo's blanket license.

                      It's a similar issue for Shippujinrai and Devilz Staircase/Sacrifice - OSTER is part of beatnation RHYZE now, and all those songs were made specifically for KONAMI. I don't think their old blanket license, back from when they were still purely independent, would be able to cover them. Shippujinrai and Staircase might be okay, since they were made before they actually became an in-house artist, but it depends on the nature of the licensing agreement they made with KONAMI.

                          Alright, yeah. He uses the same phrase there that he does on the site's about page, 「企業に提供した楽曲」, "a track offered to a business". One More Lovely -P*Light Remix- and TRIGGER★HAPPY have been removed under these grounds.

                          I've never really kept track of Bemani games and their releases, so I appreciate people who do know their stuff voicing these permission issues.

                          Also, the January-February batch is closed, so anything removed from it will not be able to be replaced with another file.

                            Usually we go with the artist's responsibility on updating their permission status. And if they still have a problem, we can always remove said song/file from our site, but this has thankfully been an extremely rare event.

                            In this instance however, looks like case closed for P*Light. I'm still glad that we can step a lot of songs from the artist, more than what bms of fighters has offered at least.

                              I'm confuse now, so... OML P*light remix and TRIGGER★HAPPY has been removed but the Hommarju remix not? or the three files in the batch has been removed?

                                This is correct. The rights to those two tracks were given to Konami. Hommarju's remix of TRIGGER★HAPPY does not appear in anything from Konami, so it still falls under pichnopop's terms of use, which allows us to use it.
