You can send it, but it'll be jim or bmah's decision whether we can judge it or not (they evaluate its official difficulty). I remember this happened to leonid in the first easy batch we had; he had no penalty whatsoever, only that his file didn't get judged.
@dragon: 1- This is a slightly tricky question as there is changes being made. You should have a decent idea of what difficulty your own files are, if not, play more!
2 - The 3 Game Managers (Jimerax, bmah & myself) take turns in releasing files each week, (I'm actually writing up this weeks front page post now). We choose files based on how long they've been in the queue, difficulty, or depending on which musicians/steppers were featured the week before.
Prepared to send 3 files. 2 Godspeed, 1 breakbeat. Though one of the Godspeed files might just be a 10... (not that one hi19, another one)
If you're not sure whether it's a 9 or a 10, can you still send it?

@dragonmega: to elaborate on what Jae said:
1. you won't know the difficulty until it's released
2. actually, any simfile judge is able to make suggestions on song releases, even though the game managers releases the songs. However, no one seems to do this, for what I think is some false misconception that only game managers get to decide on song releases. That's untrue. @simfile judges: you can suggest songs! Don't be afraid to do so!
