    The Judicial System

Lately especially, I've noticed a flurry of frivolous lawsuits pulled against people for no logical reason. I've begun to lose my faith in the legal system, really. It seems like if someone gets hurt, they'll sue, even if it wasn't anyone's fault. They're pissed off and sad, and need a scapegoat, they want repentance from someone. So they sue. And sympathetic Juries, thinking the same way, award people with money and benefits they don't deserve. Beyond that, professions are being targeted, doctors being the most noticable. Lots of doctors are abandoning more risky branches of medicine such as Vasectomies and Obstetrics, because the price for malpractice insurance is too high, and they are too scared of a lawsuit. Nowadays, anything but perfection means malpractice. Here are some examples of actual cases (ongoing or recent) that are absolutely absurd.

Betty Bullock was awarded $28 million (original verdict was $28 billion) from Phillip Morris tobacco for not warning her of the addictive qualities of tobacco, after losing a lung.

Phillip Morris payed an additional $100 million to Richard Boeken who was also a longtime smoker.

In Kentucky, a girl (willingly) performed oral sex on another boy in the back of a bus. The mother is suing the school for not keeping a close watch on them.

In Florida, a soccer mom picking up a pizza drove over the foot of an unattended child who was in the road, out of her sight. A policeman came and did not even give her a ticket. But the parents of the child tried to sue the mother, the soccer league, the city, the refs, and the sponsors of the league.

In Maine, cops searched for three days for a convicted sex offender. When they finally found him in the snowy woods, he had frostbite and lost two toes. The man threatened to sue the city for not finding him faster. (True, I kid you not).

A girl was awarded $5 million from the city when the car she was riding in swerved to avoid an ambulence, smashed into a tree and broke her leg.

A women who was on the Statten Island Ferry when it crashed was unharmed, but is suing the city and/or the ferry company for $200 million- for emotional trauma. I ask you, if you were emotionally traumatized, would you be in the state of mind enough to sue?

Something needs to be done. People are making a mockery of the legal system and it is an outrage. These needless, insane lawsuits have to stop, or eventually you'll have to have a lawyer with you full time to remind you of your rights and defend you wherever you go. Who has thoughts on this?

i cant say anything to that, its true, but i can see thier point in trying to get money, i think i would do the same thing if had the cahnce to get 5 million bucks because i broke my leg...however, you only here of these insane cases, and not the ones that can possibly be taken to court...its never as bad as the media makes it seem

These cases are all currently in the courts, or were recently settled. If I had a chance to make 5 million bucks, I probably would too. I think its stupid that our Judicial system even allows these cases in court, much less award these people for their meretricious nature.

they have the right to bring something to court if they want to, the courts cant just say they wont allow a case to be heard...

Yes, actually they can. There is a clause called the 'Summary Judgement Motion', otherwise known as 'Rule 56', that basically states that if a case is deemed frivolous it is dismissed and the suit is deemed null and void.

Makaveli, usually the defending lawyer claims Rule 56, but occasionally a judge will also rule it.

3/4ths of these people are just in it for money

About 2 weeks ago i was reffing a hockey game and a kid was injured and taken to the hospital for a CAT scan. The kid showed no signs of injury, and got up after being checked and skated off the ice. I was not informed until the next day by my refferey partner. There was talk from another parent that the childs parents were going to sue us (the reffs) for not watching the kids. So, im freaked out,, i go online and search around about the subject, and i find out that because the kid got up and we were not informed of the initial injury, we were off the hook, then i called my half uncle who is a layer, and confirmed. It turns out they were never gonna sue and i was paniced for nothing

Injured how? By being checked into the boards or something? IF that's it, then they should be suing themselves for stupidity . . .

Our law system is one of the human race's biggest flaws, followed by religon (i am religous as in the fact i believe in God, everything else to do with religon is bs)

I think it would be cool if we had a law system based on Daoist beliefs...or maybe just our lifestyle...nothing structured, no rushrushrush get here to there nownownow...but instead become in touch with our inner selves and commune in harmony with nature and stuff...Yes very Romanticism reminiscent and idealistic, but think of how happy you'd be

See the greatest part about the judical system is how much it sux

Think about it if we never had any law suits for stupid shit the world would be such a more dangerous place

Now whenever there is ice it is always salted and broken up so we dont slip

All cigarrette companys deserve to be sued for putting out an addictive live taking cancer giving DRUG to everyone and i know it is not legal to buy under 18 but that isnt stopping bullshit

Also now we have better blood tests and doctors because of all the people who sue for a minor or major mistake.

I would think that your job would have you more focused on where the puck is, seeing as to how that's where the most foul play can occur. Also, why don't they sue the family of the kid who checked theirs? THAT would at least make a LITTLE bit of sense. A little.
