I read that the guy purchased the domain name back in early 2009 thinking that MW2 would be a success and to purchase the domain name before Activision did just to mess with them. If this is true then Activision should have to buy said domain name since it was created before they trademarked the Modern Warfare 3 name.

Activision should get the site. Site squatting is illegal for a reason. They aren't being bullies, the person who was cybersquatting and just redirecting to their competition is incredibly douchy.
