The only problem is that when one is a celebrity, their lives are in many senses no longer private, regardless of what goes on behind closed doors. Even though it rarely happens, image is supposed to have everything to do with one's personal life, and when the companies who pay him millions of dollars choose to endorse him, they're looking to have their brand identified with a positive image, an image of one who makes positive choices. This is the burden he has taken on as one who's accepted endorsements. If he wants his life to be private, there are ways to make one's personal life private. He has not shied away from the cameras, now, has he?
That said, I don't view marijuana as a bad thing, and I think the public perception of it is ridiculous. But if you accept millions of dollars from people who pay you to look good for them, there's this unwritten rule that kinda says "we pay you, you stay out of trouble." So the only thing I think he did wrong is project a bad image onto his sponsors. I don't see how he's failed as a role model at all. In fact, the fact that he smokes pot and is still a winner (and one hell of a winner at that) should say something to kids after being hit with that miserable propaganda media blitz.
I think that if he were doing hard drugs or dealing drugs, while at the same time selling himself as a role model for children, I'd obviously say he's not only got to apologize, but he's got to give up the role of being a model person for the next generation.
There are a lot of celebs that don't market themselves as kids' role models, and do whatever the hell they want. Michael Phelps should consider being who he wants to be rather than the role model he's been forced into being.

The stupid thing is that somebody took a photo. Anyway, it's his fault. Regardless of whether or not the law is just, he broke the law and got caught.
Plus I bet he was smoking some crappy weed. Jocks never have good weed.
